These Terms of Use govern your access to and use of HustleFlow — an AI-powered sales assistant that helps Kenyan businesses reply to customers on WhatsApp and the web. By using HustleFlow, you agree to these terms.
1. Who we are
HustleFlow is operated by HustleFlow, Nairobi, Kenya. For questions about these terms, contact us at [email protected] or via WhatsApp at +254 791 810 255.
2. What HustleFlow does
HustleFlow provides AI-generated replies to customer messages on behalf of businesses that have signed up as pilots. The AI responds on WhatsApp and website chat widgets using a configuration set by the business (the "Operator"). HustleFlow is a tool — it does not act as a legal entity, employer, agent, or representative of any business.
3. Two types of users
These terms apply to two groups:
- Operators — businesses that sign up to deploy HustleFlow for their customers. Operators are responsible for their configuration, their customers, and complying with applicable law.
- End customers — people who chat with a HustleFlow-powered assistant via a business's WhatsApp number or website widget.
4. What operators agree to
By deploying HustleFlow, operators agree to:
- Provide accurate business information and system prompts. Misleading configurations that could harm end customers are prohibited.
- Comply with WhatsApp's Business Messaging Policy and Meta's terms of service where applicable.
- Inform their customers that AI is used to respond to messages, where required by applicable Kenyan or international law.
- Not use HustleFlow to send spam, unsolicited marketing, or messages that violate applicable law.
- Keep their WhatsApp Business account credentials and HustleFlow access credentials secure.
5. AI limitations — no guarantee of accuracy
HustleFlow uses large language models (Claude by Anthropic) to generate replies. AI-generated content may be inaccurate, incomplete, or inappropriate for a given situation. Specifically:
- HustleFlow may quote incorrect prices, availability, or product details if the business configuration is out of date.
- HustleFlow is not a substitute for professional advice — legal, medical, financial, or otherwise.
- Operators must review their configuration regularly and correct any inaccuracies.
- End customers should verify important information (prices, appointment times, legal details) directly with the business.
6. Data and privacy
HustleFlow processes customer messages in order to generate replies and detect leads. How we handle this data is described in our Privacy Policy. By using HustleFlow (as an operator or end customer), you acknowledge that message content is processed by AI systems and may be stored for the purposes described in that policy.
Operators are responsible for obtaining any consent required under Kenyan data protection law (the Data Protection Act, 2019) before routing customer conversations through HustleFlow.
7. Follow-up messages
HustleFlow may send a single automated follow-up message to a customer who has not replied after a period of time, on behalf of the operator. This is a feature operators knowingly configure. End customers who do not wish to receive follow-ups should inform the business directly, or reply "STOP" and the business will remove them from follow-up scheduling.
8. Intellectual property
HustleFlow's software, design, and brand assets (including the HustleFlow name and logo) are owned by HustleFlow and may not be copied, modified, or redistributed without written permission. Operators retain ownership of their own business content and configurations.
9. Limitation of liability
To the maximum extent permitted by Kenyan law, HustleFlow is not liable for:
- Losses arising from incorrect AI-generated replies.
- Missed sales or leads due to system downtime or AI error.
- Actions taken by end customers based on AI responses.
- Any indirect, incidental, or consequential damages arising from use of the service.
Our total liability to any operator in any 12-month period is limited to the fees paid by that operator during that period (or zero, during a free pilot).
10. Service availability
HustleFlow is currently in a pilot phase and is provided without any uptime guarantee. We may modify, suspend, or discontinue the service at any time with reasonable notice to operators. We will make reasonable efforts to notify affected operators via WhatsApp or email before any planned interruption.
11. Termination
Either party may end the arrangement at any time by giving written notice (WhatsApp or email is sufficient). On termination, HustleFlow will cease responding on behalf of the operator and will delete operator configuration data within 30 days, unless a longer retention period is required by law.
12. Changes to these terms
We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page and notify active operators via WhatsApp or email. Continued use of HustleFlow after a change constitutes acceptance of the revised terms.
13. Governing law
These terms are governed by the laws of Kenya. Any disputes will be resolved in the courts of Nairobi, Kenya, or through mutual agreement between the parties.
